Terms and Conditions
The following terms and conditions apply to all merchandise, sale, delivery and services of Diamant-Ringe. By placing an order at Diamant-Ringe, you agree to accept these general terms and conditions. No other terms or conditions apply unless explicitly detailed in writing.
Information on our Website
We strive to arrange the information on our online catalog precisely and comprehensively. We would like for you to see the form and beauty of your future ring purchase in detail. To this end, we put as much information as possible at your disposal. Certain products can appear on the computer screen larger or smaller than they are in real life. In addition, the color reproduction quality on different monitors can vary in their accuracy.
The exact weight of a diamond can deviate by up to 0.05 carats from the defined weight. This variation is normal according to industry standards, and the American FTC regulations. The certificate accompanying your diamond purchase will indicate the exact weight of your purchase.
We rely primarily on the information given on the diamond certificate with regards to the color grade, clarity, and cut of a diamond. We exclusively use certifications from internationally recognized diamond certifying boards, like GIA, HRD, EGL, or IGI. These boards guarantee the highest possible degree of accuracy in their examinations. It should be noted, however, that the evaluations of these different certification bodies can deviate plus or minus a degree from each other.
Offering Terms
Diamant-Ringe's merchandise and service offering is non-binding. Placing an order does not automatically create a contractual obligation, and an order is only considered effective with a written order confirmation from Diamante-Ringe. If the confirmed order is not fulfilled through no fault of the customer, the full amount will be refunded to the customer.
Sales Terms
A sales contract is considered confirmed only by the following process:
- The customers sends an order.
- The customer prepays the balance due.
- The customer receives our written order confirmation.
The order confirmation explicitly states the object of purchase or the service associated with the purchase. Other illustrations of the product or service offering, including those on the Diamant-Ringe web site, are not subject to this sales contract.
In some rare instances, particular diamonds of a specific quality are not or not immediately available from our suppliers. This happens more frequently with larger stones. In the case this happens with your order, we will propose an alternative to the customer. The customer will receive a refund of any applicable price difference. If no alternative is acceptable to the customer, the sales contract will be canceled and the full amount paid will be refunded.
Prices
We strive to always offer you the best possible prices. Our low overhead costs allow us to pass our savings on to the customer. Therefore, our listed prices are not negotiable.
The prices for diamonds are subject to fluctuations due to market conditions, price of raw materials, exchange rates, etc. We reserve the right to change our prices without prior notification.
Please note that despite the most careful precautions, it may occur that the prices listed on our website are incorrect. Naturally, we strive to avoid these types of mistakes. Should this happen, we will correct the mistake immediately. Nevertheless, we cannot be held accountable to honoring these prices should they be advertised incorrectly. Thank you for your understanding.
The listed prices include the value add tax (VAT) of the place of delivery. Customers who live outside of Switzerland but who prefer to fetch their purchase at our office near Zurich are responsibe themselves for importing the goods into their country. In this case the customer has to pay the Swiss VAT of currently 7.6 %. Please inform us when ordering, if you plan to pick up your jewelry at our place.
For each order we also add a flat charge for packaging and transport. This charge is due in any case.
Time for Delivery, Express Service and Shipping
We do our best to inform you as early as possible about the estimated time for delivery. Normally you will find the estimated date of delivery on your written order confirmation. If the time for delivery can not be indicated during confirmation you will receive it separately at a later time. In any case we cannot be held accountable for missing a certain date of delivery. During production we rely on many factors and therefor can not guarantee any previous indication of a delivery date.
Most of our jewelry are produced on order. We have totally time-optimized procedures. Therefor typical times for delivery are 5 to 10 business days. Please consider more time when you plan to put an order before Christmas or during spring time. Please place your order in November if it should be a Christmas present. For wedding rings also, please contact us early enough to make sure that your rings will be ready on time.
For very urgent cases we offer an express service. Please contact us by phone or email if you need your jewelry in a very short time. We may charge an extra fee for the express service.
You will receive your delivery through the post office or a courier. The package is completely insured and is thus safe during transport.
If the ring should be damaged in transit, we ask that you contact us immediately so that we can file the insurance claim. Please note that an insurance claim may be rejected due to untimely reporting and filing. In this case, we cannot be liable for compensation or damages.
Returns
For some products we grant a limited right to return the product. This only applies to products that we have on stock and are sold without modification. Please look for a corresponding note in the product description. There is explicitly no right to return a product that was produced or modified on order. Please note that actually most of our products are produced on order. The written order confirmation will state if there is a right to return the product or not.
If the right to return the product has been granted and your jewelry does not completely satisfy you, you can return it within 10 days and will receive your money back, minus a handling charge. Please read the following guidelines concerning returns. We ask for your understanding that we can only accept returns that follow these guidelines.
- We can only accept the return of jewelry that has not been worn, has no traces of use, has not been changed in any way, is not damaged and only if all accompanying documents like certificates are available in their original quality. Likewise, we cannot accept the return of engraved rings.
- Contact us and let us know that you would like to return your purchase, in perfect condition, back to us. You will then receive a return number which you can write on the delivery notice.
- Send us your ring, including the certificate, decorative ring box, delivery note, etc., reasonably packaged and insured. Insurance can be purchased at the post office at the time of sending. You will find our postal address on the Contact page. If possible, please indicate your post or bank account information where you would like us to deposit your repayment.
After receipt of your return, we will carefully examine your ring. If it is in perfect condition, you will receive back the product price minus a handling charge of CHF 150.
Guarantee
Diamant-Ringe stands behind on our products and services. We guarantee:
- Workmanship and diamond settings.
- Genuineness of materials used to craft your order.
Deficient workmanship will be corrected or replaced. Please not that normal wear or damages due to shock or destructive exposure are not covered by this guarantee.
We guarantee that the product delivered corresponds to the specification in the order confirmation letter. This applies specifically to the quality of the gold and diamonds used in your order. Industry standard deviations apply, which conform with the following minimal deviations: for diamond weight +/- 0.05 ct, other diamond parameters +/- one grading point. Please note that mostly smaller and lower quality diamonds are more roughly graded than bigger and higher quality diamonds. If the product delivered is within these specifications, there is no entitlement to guarantee. If the deviation from the specifications is out of normal standard, then we replace or repair the jewelry. Please note that complaints must be received within 8 days after receipt of the product. After 8 days the product is considered as accepted and not subject to reclaimation under the terms of the guaranty.
Certificates
Diamonds with a quality from 0.5 ct, H, SI2 and up are normally delivered with a certificate. The certificate specifies the quality of the diamond. We use one of the following globally accepted certification institutes:
- GIA - Gemological Institute of America, www.gia.edu
- HRD - Hoge Raad voor Diamant, Antwerp, www.hrdantwerp.be
- EGL - European Gemological Laboratory, www.egl.co.za
- IGI - International Gemological Institute, www.igiworldwide.com
Especially for smaller and lower-priced diamond, the cost of a certificate is not justified for this type of purchase. Should the customer require a certificate nevertheless, you can contact us. We will do our best to provide the customer with a certificate.
For diamonds without a certificate we provide the customer with a report attesting to the genuineness and the approximate quality of the diamond. The genuineness of the diamond can be attested to without any doubt. The quality of the diamond can only be approximately assessed, as the diamond is already placed in the setting when the quality control is performed. Please note, that in case of smaller and lower- priced diamonds the quality of a diamonds is specified in a greater range of approximation than for larger and higher priced diamonds.Liability
We are not responsible or liable in any way for damages, regardless of cause, in the normal or negligent use of your purchase within the normal guidelines of product liability, irregardless of any prior notification. In addition, we are not liable in any claims due to the lateness of our suppliers or our own delivery.
If your ring arrives to you, and there has been any sort of mistake or damage we will correct the mistake or repair the damage according to our guarantee. Any other liability claims cannot be considered.
Privacy Policy
Your privacy is important to us. When you order with us, we treat your information absolutely confidentially. In order to process your order, we need only your name, the ship-to address, as well as your telephone number and email address. We only use this information in connection with your purchase. As a matter of principle, no information about our customers is shared with any other third parties.
For the processing of your payment, we rely on professional and well-known online payment systems like PayPal. Any credit card information given is only known to the operator of these online payment systems, and not shared with us.
Copyright
The content on the Diamant-Ringe webpage including all texts and images etc. are under copyright. Use of any of this content for commercial use is not allowed without explicit permission. We permit the usage of our content for private use only if the source of the content and the copyright are declared.
Jurisdiction
In case of business disputes, the sole court of jurisdiction is in Zurich (Switzerland).
In cases where some statements of this contract or this 'terms and conditions' are invalid or effectless due to superior law, all other statements remain effective. The invalid or effectless paragraph will be considered and applied accordingly within the context of the superior law.
